Richard Allen Spent 13 Months in the Hole and Indiana Told the Court It Was This

Thirteen months in a cell at Westville, lights on around the clock, a camera watching, and a guard outside the door writing down everything Richard Allen said. On September 21, 2026, the State of Indiana defended every day of it to the Indiana Court of Appeals, and what its lawyer called those conditions is the thread running through this full breakdown with defense attorney Bob Motta.

The Delphi murders conviction stands on statements Allen made inside that unit in April and May 2023, 61 of them by the state's count, to his wife, his mother, guards, a warden, and the psychologist treating him. Appeal lawyer Mark Leeman argued they came from a man the prison's own psychiatrist had found on the floor covered in filth and declared gravely disabled. The state argued Allen was in restrictive housing because a county jail could not keep him safe, that the conditions were ordinary custody, and that the confessions that matter came when he was lucid.

From there the hearing went to the man the jury never heard about. Brad Holder, investigated in 2017 and never charged, has a hand tattoo Leeman says matches the sticks laid on Abby Williams, and social media posts the defense wanted jurors to see. The state's answer was a landfill time card placing him 25 miles away.

Then the bullet and the face. A single unfired cartridge was matched to Allen's pistol by a method the defense calls junk science. The sketch Betsy Blair helped draw of the man she saw on the bridge never reached the jury, because Judge Frances Gull kept it out.
