Clancy Holdout Juror Fight Just Reached the Judge

The Lindsay Clancy mistrial left one question hanging over everything: was the jury truly unable to reach a lawful verdict, or should the court have done more before ending the case? This combined episode opens with our before-the-hearing analysis with defense attorney Bob Motta, then shifts into special commentary on what actually happened at the September 29 Rule 25 hearing and the motion to un-impound juror information.

Before that hearing, the focus was the lone holdout. Multiple jurors described an 11-to-1 split favoring a verdict of not guilty by reason of lack of criminal responsibility. Foreperson Roni Carlson said the holdout acknowledged reasonable doubt but refused to join the verdict. Juror Nick Dargie said he repeatedly asked the man to identify evidence supporting his position and did not get an answer. The defense argues that sequence matters to whether Judge William Sullivan had a sufficient basis to declare a mistrial.

On September 29, Kevin Reddington pushed a different route: Rule 25. He asked Sullivan to find Clancy not guilty because, in his view, the Commonwealth had not presented legally sufficient proof. Prosecutor Shanan Buckingham rejected that characterization and pointed to the evidence and stipulations already put before the jury.

Martin Weinberg then argued over sealed jury notes and sidebar transcripts. The defense wants access because those records may become part of its double-jeopardy challenge and its claim that the holdout should have been examined more closely. Prosecutors say opening jury-room material too freely could damage the confidentiality that deliberations depend on.

Sullivan did not grant an acquittal, dismiss the case, or order an immediate retrial on September 29. He continued the litigation to November 2.
