Mega Edition: Bryan Kohberger Battles The State Over Alleged Sanctionable Offenses (10/15/26)

Bryan Kohberger’s defense and Idaho prosecutors fought bitterly over whether the state had properly complied with its discovery obligations, especially when it came to expert witnesses. In December 2024, Kohberger’s lawyers asked Judge Steven Hippler to compel fuller disclosures under Idaho Criminal Rule 16(b)(7) and to sanction the prosecution, arguing that the state had identified roughly two dozen experts but had provided meaningful written reports for only a small number of them. The defense said that was especially serious in a death-penalty case because experts were expected to testify about DNA, digital evidence and other technical subjects central to the prosecution. Kohberger’s attorneys argued that vague summaries made it impossible to know exactly what opinions the experts would offer, what methods they had used and how the defense should prepare its own experts in response. They even pointed to Idaho precedent where the death penalty had been removed as a sanction for discovery violations and argued that serious penalties, including exclusion of expert testimony, were warranted here.

Prosecutors rejected that characterization and argued that they had been continuously producing discovery and had complied with Rule 16, accusing the defense of overstating routine discovery disputes in an effort to obtain drastic sanctions. The state maintained that not every expert was required to produce a formal report and that the disclosures already provided were sufficient under Idaho law. The dispute eventually broadened into Kohberger’s attempt to strike the death penalty based in part on what his lawyers called disorganized, incomplete and prejudicial discovery practices. Judge Hippler ultimately sided with the prosecution on the central issue, ruling in April 2025 that Kohberger had not established a discovery or due-process violation serious enough to justify sanctions. He refused to strike the death penalty and declined to impose additional organizational requirements on prosecutors, concluding that the defense had not shown the kind of misconduct necessary for such an extraordinary remedy.
