Richard Allen's Prison Conditions Triggered WHAT From the Judge?!

This special Delphi episode is a combo of the “Before the Appeal” commentary followed by discussion of the appeal hearing with defense attorney Bob Motta. It moves from the arguments Richard Allen’s team planned to make into the moments that actually mattered once three Indiana Court of Appeals judges began questioning both sides.

Allen’s appeal asks for a new trial after his 2024 convictions for the murders of Abby Williams and Libby German. One major issue is whether incriminating statements made while Allen was housed in restrictive conditions at Westville Correctional Facility were voluntary. His lawyer Mark Leeman argued that Allen deteriorated psychologically during prolonged isolation and that his mental collapse cannot be separated from the statements later used against him.

The State argued that Allen was housed there to protect him, not to obtain a confession, and that the law requires coercive state action before a statement becomes involuntary on that basis. Judge Nancy Vaidik challenged that framing with six words: “You protected him into psychosis.” The panel also questioned the State about evidence the jury never heard and whether any excluded material could have changed the verdict.

The Court of Appeals took the matter under advisement. Allen remains convicted and sentenced while the panel works toward a written ruling.
