Lindsay Clancy Retrial Serves THIS Purpose — and No One Wants to Say It

The Lindsay Clancy mistrial reset the clock on a case that had already put Patrick Clancy, the families, and the public through seven weeks of devastating testimony. A retrial means all of it happens again — the 911 audio, the expert psychiatric analysis, the clinical descriptions of what happened to Cora, Dawson, and Callan — in front of a new jury that knows the last one split 11 to 1 against the prosecution.

Defense attorney Bob Motta joins the show to analyze what a second trial actually accomplishes. Lindsay Clancy is reportedly paralyzed and confined at Tewksbury State Hospital on suicide watch. Motta examines the practical difference between her current confinement in a secure psychiatric facility and a prison sentence — and whether that difference is large enough to justify the toll of another extended trial.

Motta also addresses the systemic failure this case exposes. Dr. Resnick's testimony at trial explained altruistic filicide — how severe postpartum psychosis can produce actions rooted in delusional protective impulses rather than criminal intent. Eleven jurors reportedly accepted that framework. The first-degree murder statute offers no graduated response for cases where the defendant's actions originated in a documented psychiatric crisis.

The conversation ends where the system doesn't want to go. If the state retries this case and loses, the prosecution spent enormous resources proving what 11 jurors already concluded. If the state retries and wins, the question is whether incarcerating a paralyzed, severely mentally ill woman in a prison instead of a psychiatric hospital serves anything beyond a conviction statistic.
